Currently, the states in which fictitious names are unavailable include the following: Alaska, Alabama, Arizona, Connecticut, Georgia, Kansas, Massachusetts, New Mexico, South Carolina, Virginia, and Washington. The remaining states may mandate fees of up to $204 to register your fictitious name.
Specific requirements for filing a DBA vary from state to state. In some states, you register your DBA with the State Secretary of State, in other states registration is handled at the county level.
We’ll use Jane Smith as an example. She is a sole proprietor that forms a corporation. State law required Jane to include an incorporation suffix (e.i.“INC.”) in the business name. The corporation that she forms is named “Jane’s Boutique INC”. If she doesn’t want to use the full legal name “Jane’s Boutique INC.” then she must file a DBA to market or advertise her business as “Jane’s Boutique”.
